Welcome to plixova.com. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from PLIXOVA, operated by JBLG Enterprise LLC (“we”, “us”, or “our”). By browsing the site or placing an order, you agree to these Terms. If you do not agree with them, please do not use the site.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase from us. By placing an order you confirm that you meet this requirement and that the information you give us is accurate and complete.

Your Account

You may check out as a guest or create an account. If you create one, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Tell us promptly at support@plixova.com if you believe your account has been used without your permission.

Use of Our Site

You may use plixova.com for lawful purposes only. You agree not to misuse the site, interfere with its operation or security, attempt to gain unauthorised access to any part of it, scrape or harvest data from it, or access it by any means other than the interface we provide. We may suspend or restrict access if we reasonably believe the site is being misused.

Products and Product Information

We work to display our products, descriptions, and images as accurately as possible, but we do not warrant that colours, images, measurements, or other content are perfectly accurate, complete, or error-free. Screens display colour differently, and sizing given is approximate.

We reserve the right to limit quantities, discontinue any product, and correct errors in product descriptions, availability, or pricing at any time without prior notice.

Not Medical Advice

PLIXOVA products, including the PLIXOVA Motion Strap, are general wellness and comfort products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. Nothing on this site, in our marketing, or in our customer support constitutes medical advice.

If you have an injury, persistent discomfort, a medical condition, or you are recovering from surgery, consult a qualified healthcare professional before using our products. Stop using the product and seek advice if you experience pain, numbness, swelling, skin irritation, or any other adverse reaction.

Pricing, Promotions, and Discount Codes

All prices are shown in U.S. dollars and are subject to change without notice. Any applicable taxes and shipping are shown at checkout before you pay.

Discount codes and promotions are subject to any terms stated with the offer, cannot be exchanged for cash, and unless stated otherwise cannot be combined with other offers or applied retroactively to a completed order. We may withdraw or modify a promotion at any time, and may cancel orders where a code has been used fraudulently or in a way it was not intended.

If a product is listed at an incorrect price because of a technical or typographical error, we are not obliged to fulfil the order at that price. We will contact you before proceeding and will refund you in full if you prefer to cancel.

Orders and Payment

Your order is an offer to buy. We accept it when we send you an order confirmation, and a contract is formed at that point. We may refuse or cancel any order — including after confirmation — where a product is unavailable, where there is an error in price or description, or where we reasonably suspect fraud or unauthorised use of a payment method. If we cancel an order after payment, we will refund you in full.

By submitting payment details you confirm you are authorised to use the payment method provided.

Shipping, Returns, and Refunds

Delivery is covered by our Shipping Policy, and returns, exchanges, and our 60-Day Fit Guarantee are covered by our Return and Refund Policy. Both policies form part of these Terms.

Risk of loss passes to you on delivery. Where a parcel is lost or damaged in transit, we will resolve it under our Return and Refund Policy.

Reviews and User Content

If you submit a review, photo, comment, or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and adapt it in connection with our products and marketing. You confirm that the content is your own, is accurate, and does not infringe anyone else’s rights.

We may decline to publish, edit for length or clarity, or remove content that is unlawful, misleading, offensive, or unrelated to the product. We do not edit reviews to change their sentiment or rating.

Intellectual Property

All content on this site — including text, images, video, graphics, logos, product design, page layout, and the PLIXOVA name and Motion Strap mark — is owned by or licensed to JBLG Enterprise LLC and is protected by intellectual property laws. You may not copy, reproduce, republish, distribute, or create derivative works from it without our written permission.

Our site may link to or rely on third-party websites, apps, and services, such as payment providers, carriers, and order tracking. We do not control these services and are not responsible for their content, accuracy, or practices. Your use of them is governed by their own terms.

Disclaimer of Warranties

Except as expressly stated in these Terms or required by law, the site and products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted, timely, secure, or error-free. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

Limitation of Liability

To the fullest extent permitted by law, JBLG Enterprise LLC and its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the site or products.

Our total liability for any claim relating to an order shall not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless JBLG Enterprise LLC and its officers, employees, and agents from any claim or demand, including reasonable legal fees, arising from your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.

Termination

These Terms remain in effect while you use the site. We may terminate or suspend your access at any time, without notice, if you breach them. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics, war, civil unrest, strikes, carrier failures, customs action, utility or internet outages, or government restrictions.

Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles. You agree that any dispute arising from these Terms or your use of the site will be brought in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

If you are a consumer resident in the EEA or UK, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings in your local courts.

Before starting formal proceedings, we ask that you email support@plixova.com so we have the chance to resolve the matter directly. Most issues are settled quickly this way.

Severability and Entire Agreement

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the fullest extent permitted, and the remaining provisions will stay in force. These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, form the entire agreement between you and us regarding your use of the site.

Assignment

You may not transfer or assign your rights under these Terms without our written consent. We may assign our rights and obligations, for example as part of a merger, acquisition, or sale of assets.

Electronic Communications

By using the site or emailing us, you consent to receive communications from us electronically. You agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that they be in writing.
